Terms of Use
Effective November 8, 2026. Written in plain language. See also our Privacy Policy and Accessibility statement.
The short version
- It's information, not an offer - we report what public postings and crews say. Always confirm pay, per diem and housing in writing with the employer before you travel.
- It's free - the newsletter, site, tools and reports cost nothing. Paid placements are always labeled.
- Play fair - don't scrape the site, resell our work, or send us false reports.
Agreement to these terms
These Terms of Use ("Terms") govern your use of the Per Diem Report newsletter, the website perdiemreport.com, and the tools, reports and other content we provide (together, the "Service"). By using the Service or subscribing, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service. You must be at least 18 years old to subscribe.
Information only - not a job offer
We gather job, pay, per diem, schedule, housing, licensing and project information from public job postings, news reports, government data and reader reports. This information can change or become out of date without notice, and some of it is reported to us by readers we cannot fully verify.
- No offer or guarantee - nothing in the Service is a job offer, a promise of employment, or a guarantee of pay, per diem, hours, overtime, housing, travel pay or length of work.
- We don't hire or place workers - we are not an employer, staffing agency, union, hiring hall or recruiter. You apply directly with the employer through their own posting, and any job is between you and them.
- Confirm before you travel - always get the terms of a job in writing from the employer before you accept it or travel.
Not legal, tax or financial advice
Our calculators, cheat sheets, license checker and reports are general information and estimates. They are not legal, tax, accounting, financial or licensing advice. Per diem tax treatment, licensing reciprocity and permit rules depend on your situation and can change. Check with the licensing board in the state where you will work, and with a qualified tax professional, before you rely on them.
Third-party sites and companies
The Service links to job boards, employer postings and other websites we do not control. We are not responsible for their content, accuracy, practices or availability, and a link is not an endorsement. Owners, developers, contractors, staffing firms and unions are named for information only. Unless an item is labeled "Sponsored," we are not affiliated with them and they have not endorsed us. Some links may in the future earn us a referral fee; if so, we will say so.
Sponsored content and job listings
- Labeled - paid placements are clearly marked "Sponsored" or as a paid listing.
- Real numbers - sponsors and paid listings must show real pay and per diem figures and must comply with applicable employment, wage and anti-discrimination laws.
- Our call - we may decline, edit or remove any sponsored content or listing. Sponsors buy space, not our opinion, and never receive readers' contact details.
Crew reports and things you send us
When you send a crew report, comment or other content, you confirm that it is accurate to the best of your knowledge, that it is yours to share, and that it does not reveal anyone else's private information or confidential employer information you are bound to keep secret. You give us a free, permanent, worldwide license to use, edit, combine with other data and publish it in the Service. We publish without your name or contact details unless you ask to be credited. We may decline to publish anything.
Acceptable use
You agree not to:
- copy, scrape or download the Service in bulk, or republish, resell or redistribute the newsletter or reports as your own (sharing a link, quoting a few lines with credit, or forwarding an email to a friend is welcome);
- submit false or misleading reports, or impersonate anyone;
- interfere with the Service, probe it for security weaknesses, or use it to send spam or malware;
- use the Service in any way that breaks the law.
Search engines and AI assistants may read our public pages as described in our robots.txt file.
Our content
The Service, including its text, data compilations, charts, reports, tools, design and the Per Diem Report name and logo, belongs to Per Diem Report or our licensors and is protected by copyright and trademark law. Government data we reproduce remains public. You may use the Service for your own personal, non-commercial use.
Copyright complaints
If you believe something on the Service infringes your copyright, email [email protected] with a description of the work, where it appears on the Service, your contact details, and a statement that you have a good-faith belief the use is not authorized. We will review and remove material where appropriate.
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY JOB, PAY RATE, PER DIEM, HOUSING OR OTHER INFORMATION IS CURRENT OR CORRECT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PER DIEM REPORT AND ITS OWNERS AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST WAGES, LOST OPPORTUNITIES, TRAVEL, LODGING OR RELOCATION COSTS, ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. BECAUSE THE SERVICE IS FREE, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100). Some places do not allow these limits, so they may not fully apply to you.
Indemnity
If you break these Terms or the law in using the Service, or submit content that infringes someone else's rights, you agree to cover the reasonable costs, including legal fees, that we incur as a result.
Ending your use
You can stop using the Service and unsubscribe at any time. We may suspend or end your access, remove content or change or discontinue any part of the Service at any time, for example to stop abuse. Sections that by their nature should survive (such as content licenses, disclaimers and limits of liability) continue after your use ends.
Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia and applicable U.S. federal law, without regard to conflict-of-law rules. Before filing any claim, please email us so we can try to resolve it informally within 30 days. Any claim that is not resolved must be brought in the state or federal courts located in Virginia, and you and we consent to their jurisdiction, except that either side may bring an eligible claim in small claims court.
General
If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us about the Service. You may not transfer your rights under these Terms; we may transfer ours as part of a sale or reorganization of the Service.
Changes to these terms
We may update these Terms. We will post the new version here with a new effective date and, for material changes, tell subscribers in the newsletter. Continuing to use the Service after a change takes effect means you accept the updated Terms.
